Labor Law, $537,000 Recovery
Plaintiff, a 24 year-old carpenter employed by the third party defendant construction company, was working at a renovation site when he slipped and fell on envelopes that had accumulated on the stairway. His right hand became caught in a conveyor belt on the stairway. We successfully sued the general contractor, owner of the building and lessor. Plaintiff claimed that the defendant violated the Labor Law and Industrial Code by failing to properly guard the conveyor belt. Plaintiff sustained a radial nerve neuropathy of the right (dominant) hand, carpal tunnel syndrome requiring decompression surgery, a tear of the medial and lateral menisci in both knees requiring arthroscopic surgery, and cervical and lumbar radiculopathy.
